is reportedly being sued by a US pastor over a piece of sampled audio used in a track on his latest album Donda.
The rapper is being taken to court by Bishop David Paul Moten who alleges that parts of a religious sermon he gave were used on the track Come To Life without his permission.
In court documents, the bishop said his voice and sermon were used continuously throughout the song, from the introduction to the conclusion, and that the lines consisted of over 20% of the song.
The court documents claim that parts of the sermon were used for 70 seconds in the song, in both the intro as well as being looped throughout.
Alongside Kanye, UMG Recordings, Def Jam Recordings, as well as G.O.O.D Music were named in the suit.
According to , Bishop David Paul said that it was the most recent instance of the Grammy Award winner and his related businesses ‘willfully and egregiously sampling sound recordings of others without consent or permission.’
The lawsuit comes after in the UK High Court over Kanye’s 2010 song Power, which includes samples from the 1969 song21st Century Schizoid Man from the band King Crimson.
Declan Music LTD, who owns the mechanical rights to 21st Century Schizoid Man, allege that UMG has not been paying them the proper amount of streaming royalties for Power.
Reports claim that DCM, Ye and his production company Rock The World previously signed a deal that allowed the artist to sample the track in return for a 5.33% royalty on each copy of Power sold, or ‘otherwise exploited’ and that they should receive royalties on the ‘same terms’ as Kanye.
His contract at the time stated that ‘the royalty figure for a streaming track was equivalent to that of a track on a physical CD’.
However, DCM claimed the music corporation ‘failed, and continues to fail, to comply with its royalty accounting obligations in respect of one mode of exploitation, namely the making available of the Power [r]ecording to consumers through so-called ‘streaming’ services.’
DCM alleges that UMG is only paying them a small percentage of the amount of money that’s required, with the inclusion of the streaming platforms and that they’re now looking to receive ‘all sums due’.
