Olivia Wilde has won her custody battle with her ex Jason Sudeikis, with a judge ruling that their children will live in California.

The Don’t Worry Darling director, 38, shares eight-year-old Otis and five-year-old Daisy with ex Jason, 46.

The former couple started dating in 2011 , after nine years together, with Olivia since , 28 – while Jason recently broke up with Keeley Hazell, 35.

Jason and Olivia have been co-parenting their two children since their break-up, with their son and daughter splitting their time between Los Angeles, New York and .

over where their children would officially reside after Jason served Olivia with papers on stage in April during a panel at Comic Con.

Jason had wanted the children to call New York home rather than LA, which was today denied by the judge.

Olivia had claimed the actor had served the documents ‘in the most aggressive way possible’ and claimed he had intended to ’embarrass’ her by having them delivered so publicly.

She added in court documents: ‘Jason’s actions were clearly intended to threaten me and catch me off guard.

‘He could have served me discreetly, but instead he chose to serve me in the most aggressive manner possible.

‘The fact that Jason would embarrass me professionally and put our personal conflict on public display in this manner is extremely contrary to our children’s best interests.

‘Since Jason has made it clear that we will not be able to work this out for our children’s sake outside of the court system, I filed a petition for custody in Los Angeles.’

An insider previously said that Jason had not been aware the papers would be served so dramatically, adding: ‘Papers were drawn up to establish jurisdiction relating to the children of Ms. Wilde and Mr. Sudeikis.

‘He would never condone her being served in such an inappropriate manner.’
